San Diego Seal Killer Faces 5 Years Jail Time

— A man accused of killing an elephant seal pup by repeatedly bashing it on the head with a rock has been arrested and is facing a felony charge, the District Attorney’s Office announced Wednesday.

Roy Lee Miller, 44, faces one count of cruelty to an endangered or protected animal. The incident occurred in late February underneath the North Harbor Drive bridge west of Spanish Landing, prosecutors said.

If convicted, he could be sentenced to up to five years in jail.

Miller was booked into county jail July 5, according to the Sheriff’s Department website. He pleaded not guilty in Superior Court two days later and remains held with bail set at $40,000.

Deputy District Attorney Karra Reedy said the dead seal pup was found late Feb. 26 or during the early morning hours of Feb. 27 between two pilings underneath the bridge. A passerby alerted the Coast Guard.

San Diego Harbor Police handled the investigation.

A witness told investigators that the defendant said something about the seal being noisy, and that it would not shut up, according to the prosecutor. He made statements to police indicating he believed the animal was in distress and that he was putting the seal pup out of its misery.

Elephant seals are protected under state and federal law.

Reedy said Miller is a transient who has a criminal record, including 2000 conviction for battery with serious bodily injury.
